What counts as marital property

In most states, anything either spouse acquired during the marriage is marital property and gets divided. Inheritances and gifts to one spouse are typically separate, but commingling them with marital accounts can change that.

Two-step process

First, list every asset and every debt. Second, decide how to split them. The first step is harder than people expect and the second is easier than people fear.

The kitchen-table method

If you and your spouse can sit at a table and trade items honestly, you can sketch a settlement in an afternoon. Take it to a mediator or attorney to formalize.

When mediation makes sense

If you trust each other to negotiate but want a neutral guide, mediation is the right tool. A trained mediator keeps the conversation productive and helps you reach an agreement you both feel good about.
